Where the law has something to say about Labor Day

In most of the country a school board picks its own first day. In these 5 states the holiday comes up in the rule itself — or, in one of them, is widely believed to. Each sentence below is the state's own; its page carries the same sentence with a link to the statute behind it.

Michigan
Only with a waiver. Michigan’s school code bars a public school from beginning the year before Labor Day, but a district can apply to the state superintendent to start earlier — and enough districts hold waivers that a late-August first day is now common.
Minnesota
No. Minnesota is one of the few states where the first day of school is written into the statute rather than left to the school board: a district must not begin the school year before Labor Day, and the only ways around it are a large construction project, an agreement with a district that has one, or a shared schedule with a district across a state line. Teacher workshop days can still be held in August, which is why staff are back before the students are.
New York
Yes. Despite how firmly the rule is believed, New York has no law making schools wait for Labor Day — the local board picks the date. What the state does require is 180 days of school for full state aid, counted from September onwards, which is why almost every district lands in the week around the holiday anyway.
Virginia
Yes, and most divisions do — but a division that starts before Labor Day has to close from the Friday before the holiday through the holiday itself. The first day may be no earlier than 14 days before September 1, which is around August 18.
Wisconsin
Not before September 1, which in most years means not before Labor Day. Wisconsin’s rule is a date rather than the holiday: no public school may begin classes before September 1, and only a waiver from the Department of Public Instruction for "extraordinary reasons" gets a district in earlier.
